Yourspain.es (hereinafter referred to as the „Site”) is part of Your Spain Sp. z o.o. (hereinafter referred to as „Your Spain”), a Polish limited liability company, with its registered office at ul. Jana Olbrachta 23B lok 79, 01-102 Warsaw.

Your Spain treats the personal data of Site users with respect, confidentiality and in accordance with the law, taking all reasonable steps to ensure that personal data is stored securely and accurately. Personal data used by Your Spain

When registering, submitting an inquiry, or booking a holiday home through the Site, personal data such as name, passport number, phone number, and email address will be stored in our database as Your Spain requires communication of important information such as booking confirmation, payment reminders, and other reservation information. During your visit or while browsing the Site, certain information, such as the IP address, the browser used, and information about the computer’s operating system, application version, language settings, and pages that have been viewed, may be collected.

Use of personal data

Personal data stored by Your Spain will be used for the proper functioning of the Site and the services provided, including, among others, reservations, inquiries, account administration, marketing activities, payments, communication, fraud detection and prevention, analytical purposes.

Personal Data Protection

Your Spain uses strict security measures to protect personal data and prevent their disclosure to third parties without the user’s consent. To achieve this, data storage devices are located in a secure facility with limited physical access – also, network firewalls and other means are used to restrict electronic access. Access to personal data is only granted to Your Spain’s internal staff. Your Spain will store user data in a secure manner in collaboration with our security controls. Information will be stored for a reasonable period of time or as long as required by law. In addition, payments made through Your Spain are processed through an external payment provider with a secure certificate. Your Spain does not store full credit card details and is not responsible for errors or losses in payments or transfers.

Personal data provided during account registration, as well as any other data that may be provided during the reservation process, are included in a database owned by Your Spain. Acceptance of these terms implies explicit consent to the processing of the data mentioned.

To exercise the rights to access, rectify, cancel, or object to the processing of personal data, a written request should be sent to the customer service department at office@yourspain.es

In the event that personal data of third parties are transmitted by Your Spain, the user guarantees that they are authorized to communicate such data and that they have provided the data subject with the appropriate information concerning their communication in accordance with applicable legal regulations. The user shall be responsible for any violations or penalties that may be assigned to Your Spain.

Purpose of Data Processing

Personal data provided by users through the website is used exclusively for the purpose for which the data was collected.

  • User Account: The legal basis for processing this data is the performance and provision of relevant services: managing ads and registering data to facilitate management and contact with the user. This data is stored for the duration of the commercial relationship and for the time necessary to fulfill all legal obligations.
  • Contact Form: Responding to messages initiated by interested parties. Processing this data is justified by the consent of the interested party. In this case, the data is stored according to the purpose for which it was collected and for a maximum of 2 years, unless the interested party withdraws their consent before that time.
  • Subscription to our Newsletter: Sending advertisements for our products and services; information about promotions, distribution of activities and events organized by Your Spain. Processing this data is justified by the consent of the interested party. This data will be stored until the interested party requests to cease such activities.
  • Sending inquiries: Sending and managing reservation requests to owners or managers of holiday homes advertised on Your Spain. The legal basis for collecting this data is that it is required for preliminary communication necessary for future rental agreements or pre-contractual measures taken by the interested party. This data is stored as long as the commercial relationship persists and for the years necessary to fulfill all legal obligations.

Recipients

No personal data will be disclosed to third parties. Depending on the purpose, all collected personal data are classified as a form of personal identification. Such data may include names, surnames, nationality, identity card or passport numbers, as well as personal information such as date of birth, gender, contact details, telephone number, postal address, and email address. Additionally, these data may also concern tourist properties, including cadastral data, address, tourist license number, and bank details. All of this data will be treated with strict confidentiality, using technical and organizational security measures required by applicable data protection regulations. Your Spain does not disclose this personal data to third parties, unless required for legal or jurisdictional purposes, or if the disclosure of such data is necessary in connection with the purpose of the information processing itself.

Rights of the data subject

In relation to the processing of personal data, the owner of such data may exercise their rights to access, rectify, request erasure, object, restrict processing, or withdraw consent, as well as any other options provided for in the GDPR regulations. Your Spain reserves the right to change and/or update the content of this Privacy Policy and Processing of Personal Data at any time, partially or in full. Therefore, it is recommended that the user carefully read the cookie policy each time they access the website to be fully informed of the latest and most up-to-date version of these rules.

Changes in Company Status

Your Spain reserves the right to disclose collected information to any new owner in the event of a property agreement with another company. Your Spain will not otherwise disclose, sell or distribute information to third parties without permission, unless required by law.
